Suspicion was aroused when video from that day showed Mallo embracing the mascot for a longer length of time than he did during earlier contacts. The victim stated that although Mallo had greeted the male parrot mascot as normal, he had behaved strangely toward her upon arriving. She claimed, that he touched her, prompting her to pull away from the encounter. He did this by putting his hands under her costume. In May 2021, the case was officially classified as a sexual assault after the Ninth Section of the Provincial Court of Barcelona intervened. Though the camera footage was brief, it clearly depicted an interaction that lasted longer than typical, according to the judge presiding over the case.
Mallo has been mandated by the court to pay Ana £844 in compensation, plus interest. In addition, he will have to pay £8.44 a day for 20 months, which comes to just over £5,000 ($6530). Mallo will also cover the case’s procedural expenses. Despite the fact that Mallo has been found guilty, his attorneys have not ruled out appealing the verdict.
