New Delhi: The final deadline for Indian wrestler Vinesh Phogat’s verdict from the Court of Arbitration (CAS) was again deferred on Tuesday. The verdict, which was deferred for an unprecedented third time, is expected to be announced on August 16, 2024. Although, CAS did not give any concrete statement on the date extension and the reasons, it has been notified that they have exercised it taking the Article 18 of the CAS Arbitration Rules for the Olympic Games into account.
What does Article 18 say
As per Article 18, during the period of the OG, the Panel shall give a decision within 24 hours from the conclusion of the hearing or, if no hearing is held, from the conclusion of the evidentiary proceedings, subject to Article 20. In exceptional cases, this time limit may be extended by the President or the Deputy President of the CAS ADD if circumstances so require. Outside the period of the OG, the Panel shall give a decision within a reasonable time.
Earlier on Saturday, the final deadline for Vinesh Phogat’s verdict from Court of Arbitration for Sport (CAS) was extended to August 11 and then subsequently, it was further deferred till August 13. Initially, the verdict was supposed to come on August 10 at 9.30 PM.
The hearing into India’s wrestling ace Vinesh’s appeal against her disqualification from the Paris Olympics final was concluded on Friday at the Court of Arbitration for Sport (CAS) in the French capital with the Indian Olympic Association (IOA) stating that they are expecting a “positive resolution.”
The CAS ad-hoc division, which has been specially set up for resolving disputes during the Games, had accepted one of the two pleas filed by Vinesh against her ouster for being 100 grams overweight on the morning of her final against USA’s Sarah Ann Hildebrandt, who eventually turned out to be the gold-winner. In the mega clash, Vinesh was replaced by Cuban wrestler Yusneylis Guzman Lopez, who was defeated by Vinesh in the semifinals on Tuesday.
The CAS ad hoc division, earlier, had officially registered Phogat’s application. The matter was then referred to Dr. Annabelle Bennett, who held a hearing with the concerned parties.
What was the appeal?
Phogat appealed to be awarded a joint silver medal after the disqualification in the 50kg finals. Phogat noted that her weight gain was part of the body’s natural recovery process and that she didn’t commit any fraud. She also noted that her weight had been within the prescribed limit on day 1. After being found overweight by almost 2 kg following her entry into the semifinal, Vinesh and the medical staff did everything in their power to shed the extra weight. She spent the entire night running and using the sauna, her hair and jersey were shortened but she failed to cut the last 100 gms.
The Indian Olympic Association (IOA) roped in senior counsels Harish Salve and Vidushpat Singhania to represent Vinesh Phogat before CAS in her appeal.
