Telecom Act, 2023: All about transformative rule changes from June 26, 2024

New Delhi: Parts of the changes to the Telecom Act 2023 will kick in from June 26, 2024. These changes will allow the government to have the last say with respect to telecom management when it comes to national security issues. The changes also allow for the establishment of a Digital India Fund. Know about the changes that are likely to kick in from June 26, 2024. Sections 61 and 62 of the Telecom Act will be enforced to ensure that there is regulatory continuity until new rules are formulated, according to an official notification.

What are the guiding principles of Telecom Act, 2023?

The Telecommunications Act, 2023, which replaces the Indian Telegraph Act,1885 and Indian Wireless Telegraph Act, 1933, is guided by the following 4 principles:

Samavesh or inclusion
Suraksha or security
Vriddhi or growth
Tvarit or responsiveness

These principles are expected to help India realise the vision of Viksit Bharat or a developed India.

Gazette notification on telecom rule changes

From June 26, 2024, Sections 1, 2, and 10 to 30 of the Telecom Act will stand changed. Other sections that are likely to change include 42-44, 46, 47, 50-58, 61 and 62, according to the notification.

Telecom rule changes from June 26, 2024

Telecom rule changes that are likely to kick in from June 26, 2024, include:

The government is empowered to take over telecom services in case of an emergency.
It addresses the problem of unwanted calls or unsolicited communication
The changes also provide a grievance redressal mechanism related to such unwanted calls
The changes also allow for the laying down of standards to determine assessment measures for various aspects of the industry such as telecom services, networks and security.
A regulatory sandbox is also entailed by the changes to the Telecom Act, under which the telecom industry is expected to deploy new technology and promote innovation.
The scope of the Universal Service Obligation Fund will be expanded to include universal services in rural, remote as well as urban areas. The fund will be rechristened Digital India Fund.
The new definition of telecommunications in India
Right of way framework definition has been broadened to include government agencies, local bodies as well as infrastructure to reduce disputes and ensure smoother agreement formalisation.
Common ducts and cable corridors will be established under PM Gati Shakti.
