What is defective ITR: How to understand and rectify income tax notice under section 139(9)

New Delhi: ITR Filing 2024 deadline ended on July 31, 2024, with 7.28 crore returns filed until the deadline, according to the Income Tax department. The I-T department has examined several ITRs, and ensured that refunda are processed in a timely manner. however, with several ITRs already examined by the I-T department, several taxpayers have received notices related to defective ITR.

Reasons behind defective ITR?

In a social media post, CA Brijmohan Lavaniya flagged that several of his clients had received defective ITR notices and invalid returns in AY2024025, compared to the previous assessment year. He attributed the same to the selection of incorrect ITR forms, mistakes made filing filing ITR on one’s own and “cut rate services”.

Over 61% of Income Tax Returns (ITRs) filed have been processed so far.However, there’s been a noticeable rise in defective notices and invalid returns this year.

CA Mayur J Sondagar also flagged “many defective ITR notices issued this year,” adding that it was difficult to understand these defects and to rectify them.

There are multiple reasons behind these notices sent under Section 139(9) of the I-T Act, ranging from incorrect form filled to ITR-AIS mismatch. So what should you do if the I-T notice mentions a defective ITR?

Access the Income Tax e-filing portal
Log in to your account
Select e-File and click on File ITR
When asked for reasons behind ITR filing, choose Response to Notice under section 139(9)’

Understanding defective ITR notice

The tax notice clearly mentions the reason behind the defective label.  Click on ‘agree’ if you agree with the reason provided. Otherwise, you may choose ‘disagree’ and enter a detailed explanation for it. This is done via the e-proceedings tab. However, it depends on the assessing officer whether they agree with and accept your reasoning behind disagreeing with the defective ITR notice. If the rationale is not accepted by the assessing officer, the original ITR will stand cancelled and it will be deemed that no ITR was filed by the assessee.
