Governor vs government : AG opposes Arif Mohammed Khan’s decision to form search committees

Thiruvananthapuram : The Kerala Advocate General (AG) has argued in the Kerala High Court that the governor of a state has no power to constitute a search committee unilaterally in the selection procedure of the Vice Chancellors.

The AG has made his submission following a petition filed by Mary George, former professor and head of the PG Department of Economics, University College, Thiruvananthapuram, seeking the appointment of vice-chancellors in all universities.

The submission by the AG comes after a meeting with Chief Minister Pinarayi Vijayan who had held a round of meeting with the council of ministers and legal delegates on the stance to be taken by governor Arif Mohammed Khan.

The SFI has condemned the governor’s stance and stated that Arif Khan is blatantly violating the university laws and acting against the constitutional norms.

The governors move not constitute a search committee without including the members of the university and taking a unilateral decision is nothing but against the law and the constitutional norms. The governor whose decisions that were questioned both in the Supreme Court and the High Court has still not learnt from the earlier mistakes”, said Arsho, SFI state secretary.

He said that the SFI will hold a march towards the Raj Bhavan on July 4th over the matter.

The petitioner Mary George has alleged that there is a conscious effort on the part of the government to continue ad-hocism and the continuance of vice-chancellors appointed temporarily in the universities in the state. It is detrimental to the interest of students and academic bodies.

The state had government informed the Kerala High Court that it would file a petition before the court challenging the decision of Governor Arif Mohammed Khan constituting search committees to select vice-chancellors for six state-run universities without its nominees.

The decision by the governor and the government all set to fight it out legally, the governor – government clash in Kerala looks never ending any time soon
